In a significant development, the Delhi High Court on Thursday dismissed a Public Interest Litigation (PIL) seeking the removal of Arvind Kejriwal from his position as the Chief Minister of Delhi. This decision comes after Kejriwal's recent arrest by the Enforcement Directorate (ED) in connection with a money laundering case tied to the now-defunct Delhi excise policy. The bench, led by Acting Chief Justice Manmohan, declined to delve into the merits of the issue, stating that it was beyond the purview of judicial intervention. "It is for the other wings of the government to examine in accordance with the law," the bench asserted, also including Justice Manmeet PS Arora.
During the proceedings, the court questioned the petitioner's counsel, Surjit Singh Yadav, about the legal impediments to Kejriwal continuing as Chief Minister. "There may be practical difficulties but that is something else. Where is the legal bar?" the court inquired. Arvind Kejriwal, the national convener of the Aam Aadmi Party (AAP), was apprehended on March 21 and subsequently placed in the custody of the Enforcement Directorate until March 28 by a Delhi court. He is accused of being directly involved in a conspiracy related to the formulation of the excise policy that allegedly favored specific individuals.
